外国人工作许可证办理条件及注意点 Conditions and precautions for applying for work permit

国家对办理工作许可证的定义:
外国人在中国就业3个月以上的(包括劳动报酬来源于境外,受派遣在中国工作3个月以上的),应当办理外国人就业证。外国人在中国就业的职位应当是用人单位必需的,从事技术、管理或需要特殊技能国内缺少适当人选的。

外国人工作许可证一般来说有效期1年,对于A类高端人才最长可以申请5年的工作许可证,B类专业人才最长可以申请2年的工作许可证。

根据最新的出入境管理法,任何公司和个人不得聘用没有取得就业证及居留许可的外籍员工,所以每个公司准备聘用外国人的话,必须第一时间申请办理外国人工作许可证和外国人居留许可。

外国人只能在其工作许可证上的工作单位就业,CNVISA经常会碰到一些外国人从A公司跳槽到B公司,觉得自己在A公司的就业证和居留许可尚未到期,一直拖着不去变更到B公司,这样的情况就属于非法就业。需要B公司人事特别注意,一旦有外籍员工转入,必须立即办理外国人工作许可证和居留许可证变更手续。
一般来说,如果工作许可证上的个人信息发生变化,例如:外国人住址变更或者外国人申请了新的护照号码,都需要在10天之内去办理信息变更手续。
外国人来华工作许可有效期届满未延续的,直接自动注销;外国人提前终止合同、解除聘用关系的,用人单位应当于事项发生之日起10个工作日内向决定机构申请注销。
第一次申请外国人就业证需要提供体检报告,以后延期就不需要了。

The national definition of obtaining a work permit:
Foreigners who have been employed in China for more than 3 months (including those whose labor remuneration comes from overseas and those who have been dispatched to work in China for more than 3 months) should apply for a foreigner employment certificate. The positions for foreigners to be employed in China should be necessary for the employer, and there is a lack of suitable candidates for technical, managerial, or special skills in China.
Foreigner work permits are generally valid for one year. For A-level high-end talents, a maximum of 5 years of work permits can be applied for, while B-level professional talents can apply for a maximum of 2 years of work permits.

According to the latest Exit and Entry Management Law, no company or individual is allowed to hire foreign employees without obtaining employment permits and residence permits. Therefore, if each company intends to hire foreigners, they must apply for a foreign work permit and a foreign residence permit as soon as possible.
Foreigners can only work in the work unit listed on their work permit. CNVISA often encounters some foreigners who switch from Company A to Company B, feeling that their employment permit and residence permit at Company A have not yet expired and have been dragging on without changing to Company B. This situation is considered illegal employment. Special attention needs to be paid to the personnel of Company B. Once foreign employees transfer in, they must immediately handle the procedures for changing their work permit and residence permit.
Generally speaking, if there is a change in personal information on the work permit, such as a change in the foreigner's address or the foreigner applying for a new passport number, the information change procedures need to be completed within 10 days.
If the validity period of a foreigner's work permit in China expires but is not renewed, it will be automatically cancelled; If a foreigner terminates the contract or terminates the employment relationship in advance, the employer shall apply for cancellation to the decision-making body within 10 working days from the date of the event.
For the first time applying for a foreigner's employment permit, a medical examination report is required, and there will be no need to extend it in the future.
