外国人工作转聘流程（Process of job transfer for foreigners）

根据国家相关政策要求，外国人换工作，必须申请办理外国人工作许可证转聘流程。如工作单位已经变更，但工作许可证未变更，不符合外国人来华工作的要求，视为非法就业。

外国人只变换工作单位但工作岗位未变动，且居留许可仍在有效期内，可以直接在新公司申请工作许可证及居留许可签证，无需在新公司重新申请工作许可通知。具体的办理流程如下: 


1、注销现有工作许可证。

提前终止合同、解除聘用关系的，用人单位应当于事项发生之日起10个工作日内向决定机构申请注销。用人单位被终止的，申请人可以向决定机构申请注销工作许可。


 

2、提交新工作许可申请。

注销原工作许可后，自注销之日起30日内提交新工作许可申请。 


(1)线上申请流程

进入系统后点击左侧的“境内申请外国人来华工作许可”，开始填报，上传附件材料 

①外国人来华工作许可申请表 

②聘用合同或任职证明 

③申请人护照或国际旅行证件 

④签证或有效居留许可 

⑤《外国人工作许可证》 

⑥原工作许可证注销证明。

填报完成后，提交申请，一般5个工作日出结果。


(2)注意事项 

①原居留许可到期前至少30日提出申请。

②改任新岗位(职业)的，须重新申请办理外国人来华工作许可。 

③按外国高端人才(A类)转聘的，需提交相应证明材料。 

④所有纸质材料原件及中文翻译件均须以电子方式上传至办理系统。 

⑤学历、无犯罪证明、体检等不需要重新准备提交。 

⑥新公司如没有招聘过外国人，需要办理外专局系统注册和涉外企业备案。

⑦新工作岗位需要跟原工作岗位一致。

⑧需要获取原公司的离职证明。


3、更新居留许可

取得新的来华工作许可后申请材料: 

①外国人签证申请表 

②住宿登记表 

③护照 

④外国人工作许可证 

⑤外国人居留许可申请报告



According to the requirements of relevant national policies, foreigners must apply for the transfer process of foreigners' work permits when changing jobs. If the work unit has been changed, but the work permit has not been changed, which does not meet the requirements of foreigners working in China, it shall be deemed as illegal employment.

Foreigners can directly apply for work permit and residence permit visa in the new company without having to reapply for work permit notice in the new company if they only change their work unit but their job position has not changed and their residence permit is still within the validity period. The specific processing procedure is as follows:

1. Cancel the existing work permit.

If the contract is terminated in advance or the employment relationship is terminated, the employer shall apply for cancellation to the decision-making institution within 10 working days from the date of the event. If the employer is terminated, the applicant may apply to the decision-making authority for the cancellation of the work permit.

2. Submit a new work permit application.

After canceling the original work permit, submit a new work permit application within 30 days from the date of cancellation.

(1) Online application process

After entering the system, click the "Domestic Application for Foreigner's Work Permit in China" on the left to start filling in and uploading the attachment materials

① Foreigner's work permit application form in China 

② Employment contract or employment certificate 

③ Applicant's passport or international travel certificate 

④ Visa or valid residence permit 

⑤ Foreigner's work permit 

⑥ Original work permit cancellation certificate. 

After filling out the form, submit the application, and the result usually takes 5 working days.

(2) Precautions

① Apply at least 30 days before the expiration of the original residence permit.
② Those who change to a new post (occupation) must apply for a new work permit for foreigners in China.
③ For those who are transferred to foreign high-end talents (Class A), corresponding proof materials must be submitted.
④ All original paper materials and Chinese translations must be uploaded electronically to the processing system.
⑤  Education background, certificate of no criminal record, physical examination, etc. do not need to be resubmitted.
⑥ If the new company has not recruited foreigners, it needs to go through the system registration of the Foreign Affairs Bureau and the filing of foreign-related enterprises.
⑦ The new job position needs to be consistent with the original job position.
⑧ Need to obtain a resignation certificate from the original company.
3. Update residence permit

Application materials after obtaining a new work permit for China:

① Foreigner visa application form 

② Accommodation registration form 

③ Passport 

④ Foreigner work permit 

⑤ Foreigner residence permit application report
